Terms and conditions

Before registering and opening an account with One Casino on the website www.onecasino.com, herein further referred to as “the Website”, please READ, UNDERSTAND AND AGREE TO THE FOLLOWING TERMS AND CONDITIONS AS SET OUT BELOW. When you do not understand and/or agree to these terms and conditions, you may not use the Website.

    I. Use of the Website

  1. One Casino Limited (hereafter the Operator) is the sole proprietor of the website domain www.onecasino.com, (hereafter the Website). One Casino is a company that was duly registered under Maltese law on the 4th of December 2015 with company registration number C73399, having its registered address at The penthouse - Tower Business Centre - 3rd Floor - Tower Street - Swartar BKR 4013 - Malta. One Casino was also duly licensed to provide an online gaming operation (Class 1 on Class 4 (Net Entertainment), Class 1 on Class 4 (Evolution Gaming) and Class 1) by the Malta Gaming Authority (hereafter the MGA) in accordance with license number MGA/B2C/327/2016 which was issued on the 16th of December, 2016.
  2. These Terms and Conditions are applicable to all and any use of the Website (including, without limitation, the gaming facilities, communication facilities, and product information or any material made available on the Website). Any person that uses the Website in any way will be referred to as “the User”.
  3. Any policy of One Casino or rules or requirements that appear on the Website are also applicable to all and any use of the Website. The Terms and Conditions, and all other policies and other rules and requirements that appear on the Website or that specifically relate to and govern any particular event, game, tournament or service, shall be also referred to as “the Terms and Conditions and other Rules”, and constitute a legally binding agreement between the User and One Casino.
  4. One Casino has the right to change, amend or add to the Terms and Conditions and other Rules at any time as it is deemed necessary. Any changes to the Terms and Conditions will be notified to the User in advance, and the User must re-confirm acceptance before the changes come into effect.
  5. By using and/or registering on the Website, the User agrees to be bound by and comply with the Terms and Conditions and other Rules, governing access to and the use of the Website and the User’s account(s). The User is granted access to the Website and/or his account(s) subject to strict compliance with the Terms and Conditions and other Rules. If the User does not understand and/or does not agree with the Terms and Conditions and other Rules, the User may not use the Website and/or register at the Website.
  6. The use of the Website is restricted to people under 18 years of age. Under no circumstances is the User under the age of 18 allowed to play on this site. In certain countries a higher age may apply. It is the responsibility of User to ascertain that the use of the Website is permitted to him under the laws of his country of residence or stay.
  7. The use of the Website is only permitted for ‘normal use’ and ‘excessive use’ is prohibited. User must be aware that wagering and playing games can be addictive. Users with an addiction should seek professional help. Excessive or other irresponsible use can lead to health and financial problems. User should use the Website in a responsible manner and is at all times responsible for his own behaviour.
  8. Participation in the games of the Website is permitted only to the User residing in areas where such participation is legal and not prohibited. It is the sole responsibility and liability of the User whether such participation is prohibited in his/her country of residence.
  9. The Website is merely for personal entertainment. No commercial use is allowed.
  10. The User may use the Website on his/her own behalf and not on behalf of any other person or entity.
  11. One Casino may to its sole discretion require the User to provide documentation in the requested form that prove compliance of the User with certain or all of the Terms and Conditions and other Rules. One Casino may also to its sole discretion conduct an investigation on the compliance of the User with certain or all of the Terms and Conditions and other Rules.
  12. One Casino can at any time and/or without prior notice modify the Website (including but not limited to its services, applications, gaming and communication facilities) and/or change the system specifications and/or requirements that are necessary for access and use of the Website, its services, applications, gaming and communication facilities.
  13. One Casino can at any time and/or without prior notice provide updates, enhancements, new features and/or other elements to the Website. These are automatically also subject to the Terms and Conditions and other Rules.
  14. The Website is available to User on an ‘as is’ basis. One Casino cannot guarantee access to and use of the Website at all times and at any location or with adequate capacity. One Casino shall not be liable for any impossibility to use or access the Website, any errors, system defects or interruptions, and/or any damage resulting therefrom.
  15. Bets will be refunded in these cases: If an Event with a pre-defined duration and/or with another pre-defined criterion (number of winning sets, etc.) is not started, is not concluded with an official statement on the result and/or is prematurely terminated e.g. for unforeseen events such as fog, power outage, offensive behaviour among the spectators, etc. (except for retirements and disqualification). In this context, even the Bets placed on facts related to such match, e.g. number of goals in a league round, exact result, etc., are refunded, unless these Outcomes have been closed with an Official Result. For unfinished and shortened tennis matches, handicapped Bets and Bets on the exact result placed on such matches are also refunded (including scratch User withdrawal and disqualification). If the home team is indicated incorrectly (i.e. it was the team stated in the Outcome heading as the “away” team who had the home field advantage). In this case, the Bet will be refunded regardless of the result. This provision does not apply to Bets on matches on neutral ground, tournament matches, table ranking, Bets of a long-term nature and to cases where the rival's playing field or other venue is selected voluntarily (or stipulated by the competent body).
  16. One Casino shall not guarantee that the Website, its systems, or the software obtainable on the Website, is free of defects and will operate without interruptions. One Casino shall endeavour to maintain the Website, its systems, and/or the software in a reasonable manor. One Casino shall be entitled to install temporary solutions, program bypasses or problem-avoiding restrictions in the Website, its systems, or the software. One Casino has no obligation to provide maintenance and/or support. Under no circumstances shall One Casino be obliged to recover scrambled or lost data.
  17. The User agrees to indemnify One Casino and hold One Casino harmless from any claim, demand, damage, or loss including reasonable attorneys’ fees, asserted by any third party due to or arising out of the use of User of the Website or use by any third party accessing the Website using the account of User.
  18. One Casino may to its sole discretion block use of the Website based on IP address, cookies, Accounts, or on any other basis, without notice or explanation.
  19. II. Use of Third Party Software Suppliers

  20. If and in so far as One Casino provides the User with software from Third Party Software Suppliers and/or makes software from Third Party Software Suppliers available to the User in the Website or outside the Website, the license and/or user terms and conditions imposed by such Third Party Software Supplier in relation to the software shall apply fully to the use of User of such software, notwithstanding any varying provisions in the Terms and Conditions and other Rules. The User understands and accepts afore mentioned terms imposed by Third Party Software Suppliers in full.
  21. If the User does not understand and/or does not accept said terms, the User may not use such game software available in the Website. One Casino shall provide the User with a copy of the terms free of charge upon request. If and in so far as above mentioned terms imposed by Third Party Software Suppliers in the relationship between the User and One Casino are deemed not to apply for any reason whatsoever, or are declared to be inapplicable, the provisions of the Terms and Conditions and other Rules shall stay fully in force.
  22. One Casino is not responsible nor liable for (the accuracy of) any software and /or content and/or other material of Third Party Software Suppliers and/or other third parties in the Website, and/or for content of third party websites to which the Website may have links, and/or for any damage resulting therefrom.
  23. III. Prohibited Jurisdictions

  24. The User accepts that he is obliged to be aware of the legislation of his country of residence stay or use of the Website regarding the placement of bets or the participation in games and/or gambling through online gaming websites. The User should be aware that legal requirements vary from country to country. The User accepts sole responsibility and liability for complying and fulfilling all obligations concerning the applicable jurisdiction.
  25.   26. It is possible that a country is not listed in the Terms and Conditions and other Rules but its residents are not permitted by law to play-for-money on One Casino either. It is the sole responsibility and liability of the User to verify whether play-for-money is prohibited in his country of residence stay or use of the Website.
  27. IV. Accounts

  28. If any element of the Website requires the User to open an Account, the User can open an account by filling in the registration form provided in the Website. One Casino has the right to refuse to open an account at its sole discretion.
  29. All information requested has to be provided by the User. All information provided by the User has to be correct. The User has to notify One Casino immediately in case of any changes to that information. One Casino can carry out verification procedures, by itself or through third parties. One Casino can ask for proof of the information provided by the User. One Casino can block or terminate the account of the User in the event User has supplied misleading, fraudulent or false information. Providing misleading, fraudulent or false information may constitute an offence.
  30. The User is solely responsible and liable for any information, document or data that he or a person on his behalf provides to One Casino. One Casino is entitled to use this information, document or data according to the Terms and Conditions and other Rules. The User has to make sure providing this information or document does not infringe any (intellectual property) right or any third party. The User shall indemnify One Casino against any and all claims by third parties based on the assertion that such provision or use constitutes an infringement of any rights of the third party in question.
  31. The username the User has to choose may not be offensive, has to be unique and may not infringe any intellectual property right of any third party. One Casino reserves the right to refuse a username chosen by the User on these and other grounds, to the sole discretion of One Casino.
  32. The registration and the Account of User and all his permitted use of the Website is strictly personal and non-transferrable. It is strictly forbidden to provide the personal account information, such as, but not limited to, usernames and passwords, to third parties, or use this kind of information from third parties. The User is solely responsible and liable for any use, misuse and/or abuse of his registration, the Account and all permitted use of the Website.
  33. One Casino is not required to keep a list with the names of Users and their passwords. If the User forgets, loses or for any other reason is unable to log-in to the system, or if the User gives, shares, allows or enables in any direct or indirect way others to use their access code and password, One Casino shall not be responsible and liable for any claim resulting therefrom.
  34. The User is obliged to notify One Casino immediately of any misuse and/or abuse of his registration, the Account and all permitted use of the Website. If requested by One Casino, the User has to supply proof thereof.
  35. The User may not open more than one Account in the Website. More than one account registered on the same home address is prohibited and is considered a duplicate Account. One Casino, at its sole discretion, may identify and cancel duplicate Accounts and any awards associated with these duplicate Accounts.
  36. V. Deposits, Withdrawals, Charges, Security

  37. The User has no purchase obligation to visit the open areas of the Website. If the User wants to visit the open areas of the Website, he may do so without placing bets or making deposits.
  38. The User needs funds in the Account to be able to participate in game play for money. The Website operates in the currencies Euro’s (EUR), Danish Krone (DKK). A deposit in other currency shall be converted to one of the aforementioned currencies. Not all payment methods are available in all countries.
  39. In the event the User makes use of a bank for any deposit or withdrawal, it is possible that the bank adds handling charges. One Casino is not responsible or liable for these charges. The User may find more information regarding payment options and charges on the said Banking page in the Website. If the User requires more information, the User can contact his bank or other financial institution.
  40. The User understands that by using the Website he can lose funds deposited in his Account.
  41. The User may not deposit funds to his Account and withdraw these funds or part(s) of these funds at a later stage to (mis)use the difference and/or fluctuations in currency rates. In the event One Casino suspects any (mis)use as afore mentioned, One Casino has the right to return these funds upon a withdrawal request and apply the currency exchange rate applicable at the moment of deposit. Additional penalties may be applied and can vary from 5 percent to 25 percent of the amount of the withdrawal, depending on the time period that such funds were held in the Account and the exchange rate fluctuations during that time period, to the sole discretion of One Casino. One Casino may also block or terminate the Account.
  42. The User is exclusively responsible for possible applicable taxes under applicable laws for any winnings that the User receives from One Casino or any withdrawals from the Account. The User shall not be entitled to any interest on any funds in the Account or any amounts held by One Casino.
  43. By depositing any funds in the Account, the User declares that no deposited funds are illegal or derived from any illegal activity or source, in any direct or indirect way.
  44. To deposit and/or withdraw into and from the Account, the User is only entitled to use valid financial resources that belong rightfully to the User.
  45. One Casino shall not be liable for any unauthorized use of payment resources, such as credit cards, regardless of whether or not these payment resources are reported stolen.
  46. For all countries One Casino shall only pay withdrawals to the same payment method used to make the deposit.
  47. To the sole discretion of One Casino, One Casino can apply this policy to other jurisdictions as well.
  48. For security reasons, withdrawals will only be paid to the User that by registering in the Website opened the Account that holds the funds to be withdrawn. Withdrawals shall not be paid to third party accounts. In some cases, personal identification documentation or proof of residence or other information or documents will be requested before One Casino allows a deposit or withdrawal in order to confirm the User’s identity and for other security and anti-fraud reasons, to the sole discretion of One Casino. In some cases, this process might delay the payment of withdrawals.
  49. In the event User is deceased One Casino may pay deposits or funds to the surviving heirs of the User. One Casino may require to its sole discretion certain documents to proof the stated death and/or other stated information.
  50. One Casino is not responsible or liable for any delays in payments when incorrect or incomplete information is provided by the User or requested verification, documents or information is not provided by the User in a correct or timely manner or due to any error, malfunction, fault or delay of any third party, such as payment providers, banks or government bodies, or due to any force majeure.
  51. The User is fully responsible and liable for any amounts owed to One Casino. The User is not entitled to (try to) make ‘charge-back’s or attest or reverse any payment made regarding any amount owed to One Casino. The User is obliged to reimburse One Casino for any costs or damages incurred as regards to any charge-back, attested or reversed payment.
  52. In case One Casino suspects any fraudulent, illegal or wrongful activity of the User, or in case of any ‘charge-back’, One Casino can withhold funds from the Account of User.
  53. In case One Casino mistakenly credit the Account of the User with winnings or other monies that do not belong to the User, the monies remain the property of One Casino. The User is obliged to notify One Casino when noticing any incorrect crediting. One Casino shall be entitled to transfer these funds from this Account. If the User has withdrawn the mistakenly credited amount from his Account, this amount constitutes a debt of the User to One Casino, that will be due and payable immediately.
  54. In the event of a debt collection process by One Casino against the User, any payment by the User will first be applied to settle the accrued interest and charges and only then will any remaining amount be applied to reduce the principal sum.
  55. One Casino can use payment providers or payment processors to receive or pay funds or act on behalf of One Casino.
  56. One Casino can decide that certain payment methods, such as certain credit cards, are not permitted anymore, or for a certain period of time or only under certain additional conditions. One Casino can suspend or withhold payments to Users using these payment methods. One Casino shall not be liable for these measures.
  57. One Casino operates in conformity with international financial standards. Therefore One Casino is entitled to hold any kind of financial transaction and amounts that might be suspected of fraud. The User trying to commit fraud on the system(s) of One Casino or the Website will have his Account cancelled and will not be able to place bets or request withdrawals. If the fraud is confirmed, the company will follow international regulatory compliance processes and any remaining amount will be refunded to the entities that made the User’s deposit in the first place. One Casino is obliged to follow instructions of competent (government) authorities in the event the law or any court order so dictates. In the event it is not clear to One Casino to which entity the amounts should be refunded, One Casino is entitled to hold the amounts until there is sufficient clarity, to the sole discretion of One Casino. Any damage and/or costs resulting therefrom have to be paid by the User to One Casino.
  58. One Casino is subject to the Anti-Money Laundering Act of Malta and therefore shall report any suspicious transaction to the competent authorities within the jurisdiction of Malta. One Casino is entitled to hold any kind of financial transaction and amounts that might be suspected of money laundering.
  59. The User that has knowledge of or suspects any suspicious activity or transaction has to report this immediately to One Casino.
  60. One Casino monitors all activities and communication of Users in the Website to verify that no illegal, fraudulent or non-permitted activities take place. By using the Website, the User agrees to be monitored by One Casino. If One Casino considers that the User is in breach of any of the Terms and Conditions and other Rules, or that the User may be acting illegally or fraudulently, it may at any time without prior notice, terminate and/or suspend the User’s use of the Website and/or suspend or terminate the Account. In such circumstances One Casino will not be under any obligation to refund or otherwise reimburse the User for any of the funds in the Account.
  61. VI. General Bonus terms

  62. Bonuses will always be added to the User’s Bonus and need to be turned over (wagered) a certain number of times before the bonus funds can be withdrawn. The number of times that a bonus needs to be turned over varies from one bonus to another.
  63. A bonus can be wagered (turned over) by placing bets. When User completes the bonus’ wager requirements for 100% the bonus will be transferred to the User’s balance.
  64. During the wagering process there’s a risk to lose the bonus. This doesn’t cost the user ‘real money’.
  65. Balance funds (real money that can be withdrawn) will be used prior to Bonus funds. Bonus funds will only be used when the user has insufficient balance funds.
  66. Balance wagered bonuses and no-wager bonuses will be void when a withdrawal is requested. Cancelling a withdrawal will not restore any bonuses removed.
  67. No-wager bonuses cannot turn into real money. When using the bonus all winnings will be in real cash when a No-wager bonus is used.
  68. Regular bonus funds cannot be withdrawn until the bonus turns into balance funds by completing the wagering requirements. Regular bonuses can be completed by using that particular bonus for placing bets at One Casino.
  69. Balance-wagered bonuses will turn into real money after the wagering requirements have been met. User can meet the wagering requirements by betting the value of the bonus for a specific number of times. Only bets placed by using real cash funds will wager the bonus.
  70. Cash Back is given as a no-wager bonus.
  71. In rare cases when User completes a bonus for over 100% and isn’t transferred to the User’s balance, it is the User’s responsibility to contact One Casino’s customer service. One Casino cannot be held responsible when a bonus is lost after a 100% completion.
  72. One Casino reserves the right to exclude Users from promotions if there’s any reason to believe that said User is abusing promotional offers.
  73. One Casino reserves the right to cancel or change a bonus offer at any time without prior notice to the User.
  74. One Casino reserves the right to change the benefits of Club One Member program at any time without prior notice to the User.
  75. When a User wins a prize when using a no-wager or balance-wagered bonus for placing bets, the amount of the bet will be given as bonus funds. When the prize is higher than the initial bet, the remaining amount will be given as real cash (Balance).
  76. One Casino’s bonus offers won’t apply for self-excluded Users or for Users with a ‘frozen account’.
  77. Both a bonus and winnings from bonus will be voided on or after the bonus’ expiry date.
  78. One Casino’s bonuses are applicable for one person per household only.
  79. One Casino reserves the right to determine a maximum bet per round when a bonus is being used.
  80. One Casino reserves the right to determine whether a game can be used for betting bonus money or not. This can differ from game to game.
  81. When a bet is placed on a Table Game and a bonus is active, only 10% of the value of the bet will count in the wagering requirements. Bets placed on Roulette or on any Live Casino game do not count in the wagering requirements.
  82. Bonuses cannot be used to buy scratch cards.
  83. For the sign up deposit bonus there’s a maximum deposit bonus of € 100,- unless otherwise stated.
  84. Additional bonus terms may apply. Please check each bonus’ terms and conditions for the additional bonus terms.
  85. There is a € 5,- maximum bet active on our bonuses (such as deposit bonuses). One Casino reserves the right to not payout any winnings resulting from bonus bets and exclude players from bonus offers when the maximum bet has been exceeded.
  86. VII. Termination of an Account and Inactive Accounts

  87. The User can request to terminate or re-open his Account at any time by sending a message to the helpdesk of One Casino that decides on such requests.
  88. The User can request One Casino to return available account balances to the User upon termination and at the latest within 30 days after the termination of the Account, after which period the User cannot make any claims to any funds in the Account. The return of available balances shall be executed as a withdrawal request. Possible fees and conditions in connection with withdrawals, as set out in the Terms and Conditions and other Rules, will apply. One Casino can collect fees, surcharges or costs incurred before termination and execution of the request for return of available balances.
  89. VIII. Participation in Activities and Winnings

  90. Involvement in any fraudulent, collusive, fixing, other wrongful activity or any other activity that cannot be reasonably considered normal use of the games in the Website is strictly forbidden. The User is not allowed to use any software-assisted methods, techniques or hardware devices for participation in any games, bets or other activities within the Website. One Casino is entitled to block or terminate the Account or invalidate the User's participation in a game, bet or other activity in the event of such activity, to the sole discretion of One Casino.
  91. In case services provided via the Website are being abused in any way, including by way of example due to a previously undetected fault, bug or other fault in the software, we may reserve the right to cancel or suspend withdrawals and close accounts with immediate effect.
  92. It is forbidden for employees or affiliates of One Casino to open an Account and participate in a game play for real money. One Casino can hold and/or cancel payments to an employee or (affiliate payments to) an affiliate that participated in real money game play.
  93. One Casino is not responsible for the User’s computer malfunctions or attempts by the User to participate in games using methods not designed and authorized by One Casino. The malfunction of the game voids all plays and prizes, to the sole discretion of One Casino.
  94. If User has any problem engaging in any of the games of One Casino, User has to report this immediately to One Casino, accompanied with Users’ user name, exact date and time of the problematic use, the game concerned and a detailed description of the problem.
  95. In cases of unclarity concerning a stake placed or amounts won in a certain session, The One Casino department that holds responsibility shall conduct an investigation on the matter. The decision that concludes the investigation is made by the Head of that specific department, which is binding and final.
  96. Any values passed to the User in the form of bonuses should solely be used for betting on the Website. Bonuses have limited validity. Redemption of such bonuses is prohibited. If a User withdraws before having reached the wager requirements as set out in the Terms and Conditions and other Rules, or if the User has wagered the bonus without complying with the applicable terms, the User’s bonus and winnings will be void. This cannot be undone by User nor by One Casino.
  97. Prizes may be claimed by the User upon request. One Casino endeavours to, without any guarantee, to deposit withdrawals that are confirmed and released by the Website, in the Account within 3 business days.
  98. Before the User's first withdrawal can be processed, the User needs to be verified by sending in copies of:
    - Identification
    - Proof of address (Recent utility bill)
    - Proof of finance, if required (Recent bank/creditcard statement)

    After the User's verification request is accepted, the User is allowed to request a withdrawal.
  99. Amounts of € 17,50 and above can be withdrawn. A minimum deposit of € 10,- is required in order to request the first withdrawal. Withdraw requests on credit card accounts will be wired in instalments of € 25 000,-.
  100. The Operator reserves the right to refuse a withdrawal request where the User has not wagered any of the deposited funds. In such cases, the deposit fees incurred by the Operator will be deducted from the funds withdrawn by the User.
  101. Withdrawals processed by the payment provider concerned cannot be used anymore by User in the Website.
  102. Prizes higher than € 15 000,- are subject to verification and reconciliation. In such cases withdrawal payments will be extended with 2 business days.
  103. Requests for withdrawals are only permitted and can only be carried out when issued through the facilities of the Website.
  104. One Casino shall only pay a prize, execute a withdrawal request or execute any other transaction to the User, when the User has met all conditions and has not violate any rule as set out in the Terms and Conditions and other Rules, which will be monitored by One Casino.
  105. One Casino reserves the right to suspend payment or close/block the account with no prior notice or explanation when foul play is suspected.
  106. Anonymous data such as, but not limited to, user names, avatars, prizes, date and time, may be used by One Casino to its sole discretion for promotional purposes and can be shared with or transferred to third parties.
  107. IX. Intellectual Property Rights

  108. Any trademark, logo or other material published on the Website or the (license to the) internet domain itself, and all technical systems and software within or related to the Website, is and remains the intellectual property of One Casino and/or Third Party Suppliers and/or other third parties. The User is not allowed to use these without the explicit written approval of One Casino or the third party that holds such intellectual property rights. If the User infringes any intellectual property published on the Website, the User is fully responsible and liable for any damage resulting therefrom.
  109. The User may need to download software from the Website to be able to participate in any activity. In that event the User obtains only the right to use this software according to the Terms and Conditions and other Rules and/or applicable terms and conditions of the Third Party Supplier that holds the property rights to such software. The right of use of the software shall in all cases be non-exclusive, non-transferable and non-sublicensable The User is not permitted to remove or amend any details or elements of the software he has obtained through the Website or from One Casino. Under no circumstances shall the User remove or circumvent technical provisions intended to protect the software, or arrange for this to be carried out. The User acknowledges that non-compliance with this article constitutes an infringement of the intellectual property rights of One Casino or a Third Party Supplier or other third party, and the User will be liable for any damages resulting from that infringement.
  110. The User is not entitled to use or publish links to the Website and/or internal pages of the Website in any way, without the explicit written consent of One Casino.
  111. It is prohibited to use any spider, web crawler, robot, screen scraper, automated query program or other automatic or manual process to monitor or copy the Website or contents of the Website without the explicit written approval of One Casino. It is prohibited to use any device, software or technique to (try to) interfere with the proper working of the Website and its systems. The User is not allowed to take any action that incur an unreasonable or disproportionately large load on the infrastructure of the Website. The User may not copy, reproduce, alter, modify, create derivative works, or publicly display any content from the Website without the explicit written approval of One Casino or the Third Party Supplier or other third party that holds the intellectual property rights to such works.
  112. X. Liability and Compensation

  113. One Casino shall not be liable for any damages suffered by the User resulting from any use of the Website, except in cases of intentional acts or deliberate recklessness on the part of One Casino.
  114. The total liability of One Casino shall be limited to compensation of the stake placed, which stake resulted in or is directly connected to the damage or loss concerned.
  115. The liability of One Casino for indirect damage or loss, resulting loss, loss of profit, loss of savings, reduced goodwill, loss due to business interruption, loss in connection with the use of items, materials or software provided by third parties, or other forms of indirect damage, shall be excluded. The liability of One Casino due to the scrambling, destruction or loss of data or documents shall also be excluded.
  116. These exclusions and restrictions shall not affect the exclusions and restrictions to One Casino’s liability, as described in the Terms and Conditions and other Rules in any way.
  117. Except where performance by One Casino is permanently impossible, One Casino shall only be liable if the User gives One Casino immediate notice of default in writing, setting a reasonable term in which the breach can be remedied, and One Casino still attributably fails to meet its obligations after this period. The notice of default must contain as comprehensive and detailed a description of the breach as possible, in order to ensure that One Casino has the opportunity to respond adequately.
  118. A strict condition for the existence of any right to compensation shall in all cases be that the User notifies One Casino in writing of the loss or damage immediately after it occurs, accompanied by a detailed description of the loss or damage and the circumstances concerned. Any right to claim damages against One Casino shall in any case expire by the mere passage of twelve (12) months from the date on which the claim arose.
  119. The provisions of this article and all other restrictions and exclusions of liability referred to in the Terms and Conditions and other Rules shall also apply in favour of all (legal) persons that One Casino engages to execute the Agreement.
  120. In the event of any breach of the User or any failure of the User to comply with the Terms and Conditions and other Rules, the User is in default without any notice of One Casino being necessary. In that event the User is liable for all costs incurred and damages suffered by One Casino. One Casino is entitled to start any legal proceedings (including injunction proceedings) to ascertain its rights and to prevent the User for causing more damage and costs.
  121. XI. Force Majeure

  122. Neither of the parties shall be obliged to meet any obligations, including any guarantee obligation agreed between the parties, if it is prevented from doing so as a result of force majeure. Force majeure includes, without limitation: (i) a situation of force majeure encountered by One Casino's suppliers, Third Party Suppliers or other third parties, including but not limited to hosting- and software providers, (ii) failure by secondary suppliers engaged by One Casino to duly meet their obligations, (iii) the defectiveness of items, hardware, software or materials provided by third parties, (iv) government measures, (v) electricity failure, (vi) faults, errors or interruptions affecting the internet, computer network, infrastructure or telecommunication facilities, (vii) war, (viii) workload, (ix) strike action, (x) general transport problems and (xi) the unavailability of one or more members of staff, and (xii) acts of God and/or natural disasters.
  123. If a situation of force majeure lasts for longer than ninety (90) days, either of the parties shall be entitled to terminate the Agreement in writing or through any procedure One Casino provides in the Website. The services already performed in connection with the Agreement shall in this case be settled on a pro rata basis, and the parties shall not owe one another any other amounts.
  124. XII. Miscellaneous

  125. When a limit is set, only bets from balance funds will count as ‘wager’ or ‘loss’.
  126. The User’s rights and/or obligations under the Terms and Conditions and other Rules are not transferrable. One Casino can transfer her rights and/or obligations to a third party with notice thereof to the User. The User agrees on forehand with this transfer.
  127. The failure of One Casino to require the performance of any provision or condition of the Terms and Conditions and other Rules, shall not affect One Casino's right to require performance at any time thereafter, nor shall a waiver of any breach or default of the Terms and Conditions and other Rules constitute a waiver of any subsequent breach of the same or default or any other a waiver of the provision or condition itself.
  128. If any provision of this Contract is held unenforceable, then such provision will be modified to reflect the parties' intention. All remaining provisions of this Contract shall remain in full force and effect.
  129. The Terms and Conditions and other Rules are originally in English. In case of translation the English version will prevail.
  130. The Terms and Conditions and other Rules shall be exclusively governed by the laws of Malta. Possible applicability of the Convention on Contracts for the International Sale of Goods 1980 is excluded.
  131. Any disputes that may arise between One Casino and the User, either as considered as a dispute by both parties or otherwise, on the basis of an agreement concluded between One Casino and the User or as a result of further agreements that arise from such an agreement, can be brought exclusively before the Court of First Instance in Malta or any successor.
  132. All General Terms and Conditions (including specific Bonus Terms and Conditions) have been prepared in various languages other than English for reference only. In the event of any differences between the English version of these Terms and Conditions and any non-English versions, the English version shall prevail.
  133. Users may file reasoned complaints and claims to the Operator who shall immediately investigate the same and inform the complainant/claimant of the result within 21 days of their filing (delivery). The Operator reserves the right to request any information from the User in order to be able to investigate and resolve the claim/complaint appropriately.
  134. Claims on Winnings are to be made by sending a copy of the claimed Ticket, together with a justification, through the Online Application or by means of an e-mail containing a description of the identified defect to be sent to the following address: to help@onecasino.com.
  135. Claims on Winnings and therefore also on the turnover on the User Account and balances indicated therein, must be claimed within 30 days of the Bets evaluation of Bets in the Online Application and after the User has been granted access to the respective balance on the User Account in the Online Application. If the User fails to file a claim within the mentioned period, it is assumed that the User agrees with the Bet evaluation and hence with the balance on the User Account; the User loses his/her entitlement to a correction of the Bet after the lapse of this claim period and shall no longer be able to successfully raise any other claims relating to the respective Bet.

    When assessing disputes regarding a placed Bet, the information stored in the computer database of the Operator shall prevail. Claims made in any manner other than that mentioned above will be disregarded. Each shall party bear its own claim-related expenses. Should the User not be satisfied with the resolution suggested by the Operator, the User may direct its complaint or claim to the Malta Gaming Authority (MGA).
  136. The Operator ensures that all the proper checks are in place to ensure the utmost privacy and security of every User Account. The Operator is registered with the Data Protection Commissioner of Malta in accordance with the Data Protection Act and all other relevant legislation. By registering a User Account, the User is hereby accepting that all personal information provided to the Operator shall be treated in utmost confidentiality and shall not be stored longer than is absolutely necessary in accordance with the relevant laws. Supply of any personal information of the User to third party providers will only be done on an Opt-in basis. However, the Operator reserves the right to conduct a security review at any time as it may deem fit in order to ensure that its security levels are at their highest. The Operator further reserves the right to make any inquiry deemed necessary into the User Account and if necessary, disclose such information to a third party for verification purposes in suspicious cases. The User thus hereby also undertakes to provide to the Operator any information that may be necessary for this purpose.
  137. Furthermore, and notwithstanding any of the above, upon registration the User expressly consents and acknowledges that his/her personal data may be supplied to third parties being the Operator’s service providers. Such service providers would without limitation include marketing providers, promotional event organisers etc.

    The User also expressly consents the Operator to share the User’s personal details with group companies and related parties of One Casino Limited.
  138. The User hereby binds himself/herself by all the relevant Anti-Money Laundering Regulations in force in Malta and across the European Union. The User therefore binds himself/herself not to use the gaming services provided by the Operator and/or the Website for the purposes of money laundering and/or the funding of terrorism, whether directly or indirectly. The Operator reserves the right to take any measures that would be required in order to obtain or verify a User’s identification. The Operator shall likewise have the right to refuse the opening of a User Account, cancel/suspend a User Account, refuse deposits and/or withdrawals when a user does not provide the requested information/documentation and in all those cases where it has a suspicion that the User is making use of the Website for such illicit purposes or that a transaction was used for such purposes. Finally, the Operator shall have the right to disclose any/all details of the suspicious transaction to the appropriate authorities in Malta being the MGA and the Financial Intelligence Analysis Unit.
  139. The Operator reserves the right to reject the registration of any User and/or enter into the Agreement and decide on the termination of any Agreement and exclusion of any User from participating in the game without having to give any reason. The User has no legal entitlement to enter into the Agreement. In the event that no transaction is recorded in a User Account for a period of 30 consecutive months, the account shall be deemed to be inactive and will be cancelled. In such case, the Operator shall remit the balance in that User Account to the User, or if the User cannot be satisfactorily located, to the MGA. No claim shall lie against the Operator after it has remitted the balance to the MGA. The Operator shall not be liable for any damage and losses incurred directly or indirectly due to any random or unintended disruption to the website and/or the contents thereof. Furthermore, the Operator shall not be liable for operations not carried out, or carried out in an untimely manner, if these arise from the failure of electronic communications networks, incorrect control of the website and other technical problems. The Operator shall not be liable for any misuse of the website content by the User or a third party. The Operator shall not be liable for damage caused to the User or a third party if this damage was caused by incorrect interpretation or errors in the website content. The Operator reserves the right to terminate the Agreement with immediate effect without stating any reason and to exclude the User and/or reject any financial transfer from his/her User Account, particularly when the User:
    1. fails to provide truthful information during registration
    2. breaches the betting terms of the Operator (Terms, Rules, Detailed Rules etc.)

    This does not affect the right of Operator to compensation of damages, including lost profits. Cases not covered in the Terms, the Rules and/or the Detailed Rules are subject to the decision of the Operator, which decision shall be binding on the User. In the event of death of the User, the Operator will enable the payout of the User Account to the legitimate heir after required documents have been presented. The Operator bears no responsibility for operations carried out by respective state authorities, notaries, testamentary executors and other persons involved in the disposal of the deceased User’s estate.

    The User is obliged to notify the Operator without delay about any and all changes occurring to the personal data provided and further facts related to the provision of services in the Online Application, which may lead to his/her unjustified enrichment or cause damage to the Operator. Any illegal or suspicious conduct by the User may be reported to the respective authorities. Operator is entitled to charge for certain services and products in accordance with the Rate book. The Rate book must be published in the Online Application at least seven days prior to the effective date of its validity. Operator reserves the right to amend these Terms at any time at its discretion and as it deems fit. The updated Terms shall be notified to the User for approval as soon as he/she first logs in following the amendments to the Terms, and the updated Terms shall also be published in the Online Application. Should the User refuse to accept such amendment to the Terms, the Operator shall block the User Account until the approval of the User is obtained. Any letter sent electronically to the e-mail address is regarded as delivered on the third day following the date on which it was sent. Letters sent per post are regarded as delivered on the fifth day from their being sent, unless it can be demonstrated that delivery took place on a different date. These Terms shall solely be governed by the Laws of Malta without any regard for any conflict of laws. If a dispute arises with regard to the Terms or in general regarding the contract between the Operator and the User, the Laws of Malta shall apply. In the event that the Operator and the User (hereafter referred to jointly as the Parties) do not reach an agreement to their dispute, they shall submit themselves to the jurisdiction of the Maltese Courts. We reserve the right to make changes to these Terms and Conditions at any time. It is therefore the User’s responsibility to check these Terms and Conditions from time to time to ensure that they agree with them, and their continued use of the website will be deemed to be acceptance of any changes we may make. If the User has made a complaint to the Operator in relation to one of our licensed products and they feel that the final decision about the dispute was not dealt with satisfactorily, the User can raise any unresolved dispute with the Malta Gaming Authority by emailing: support.mga@mga.org.mt.
  140. How to effect Self Imposed Limits

    The User has the option to apply the following restrictions (limits) to the User’s account:

    • Restriction of monetary amounts that may be used during a specified period on our website.
    • Restriction of the losses that may be made during a certain time on the User’s account.
    • Restriction on the amount that may be bet during a certain time on our website.
    • Restriction on the amount of time the User may play in a single session on our website.
  141. Should the User wish to apply, cancel or amend one of the above restrictions to the User account, the User may do so through the ‘Account Settings’ on the Website or by contacting our customer service in writing or by e-mail. The limits that the User requests shall be implemented:

    • in the case of cancelling or increasing the limit, or cancelling the blocking of the User’s account, within 7 days following receipt by us of the request
    • in the case of reducing the limit or extending the blocking of the User account, directly following receipt by us of the request.
    We shall not accept any disposals on the User account that do not correspond with the limits the User has chosen.
  142. If no activity is recorded on the User account for longer than 30 months the account shall be deemed to be a dormant account under Malta’s Remote Gaming Regulations (LN 176 of 2004). We shall transfer the credit that may be on the User account to the bank account stated by the User in the User account. If details of a bank account have not been stated in the User account, we shall make every effort to pay out the money to the User. The User may also contact our customer service on help@onecasino.com to request that any remaining funds are refunded. In the event that this is not successful, the money shall be transferred to the Malta Gaming Authority provided that no claim shall lie against us. The User would then need to lodge a formal request for the MGA to release the funds.
  143. In the event that any information is incorrectly published on the website, the Operator will take remedial action in order to rectify and amend the data in the system so as to reflect the correct information. Any winnings that are affected by the publishing of incorrect information will also be accordingly amended. In the event of a miscarried game for any reason whatsoever, all Users’ transactions are always accurately logged on our systems. Kindly contact our customer care team for any queries via email on help@onecasino.com. We reserve the right to correct or declare results void with hindsight, if the result of the game was caused by a technical default, fraudulent behaviour of a User or through a fake wager. We reserve the right to recall any payment that is made in error.
  144. We are required to comply with data protection requirements in the way the Company uses any personal information collected during the User’s visit to the Website. We therefore take our obligations in relation to the way we use the User’s personal information very seriously. The Company shall handle all personal information provided by the User strictly in accordance with the Privacy Policy. By providing us with the information the User agrees with our right to process his or her personal information for the purposes described in the Terms or purposes of Website administration or compliance with the legal or regulatory obligation. It is the Company’s policy to not disclose any personal information to anyone except to the employees that need an access to the User’s data to provide you with the service. We will retain copies of all the User’s communications with us (including copies of any emails) in order to maintain the accurate records of the information that we have received from the User.
  145. The deposit methods that are available are the following:

    • Skrill

    • Neteller
    • Trustly

    New payment methods may be added from time to time
  146. Withdrawal will be processed within a maximum of three business days from the day when we have all your due diligence documents in hand and approved. When possible, withdrawals will be processed to the same account as used for depositing. In certain circumstances paying the withdrawal to the same deposit account might not be possible. In these cases, a new account must be provided by the User.
  147. Any changes to the Terms and Conditions will be notified to Users in advance and the User must re-confirm acceptance, before changes come into effect.
  148. The Operator reserves the right to limit/refuse bets.
  149. The Operator reserves the right to terminate events and/or games.
  150. The User must give a valid identification, address, and contact email or personal telephone number, and the User must register in person.
  151. It is prohibited for Users to sell, transfer, and/or acquire accounts to/from other Users.
  152. It is prohibited for Users to transfer funds amongst User accounts.
  153. Users shall not treat the Operator as a financial institution nor expect interest on their deposits.
  154. The identity of a User will be verified on cumulative deposits of € 2 000,-.
