Terms and conditions

  1. Introduction
    1. The Terms and Conditions defined in this document regulate the usage of the games (the "Games") provided through www.onecasino.com and the other URLs, mobile telephone applications or other products and services licensed to, belonging to or provided by One Casino Limited (the "Website") (collectively, the "Service"). These Terms and Conditions are required to be accepted by you upon registration and you will only be allowed to play for money upon acceptance of these Terms and Conditions.
    2. These Terms and Conditions, the rules applicable to every game on the Website (the "Game Rules") and any document expressly referred to in them, as well as any guidelines or rules posted on the Website constitute the agreement and understanding between the Parties and govern the contractual relationship between One Casino Limited and the Service account holder (the "Account Holder") (and are collectively referred to in this document as the "Agreement"). Please read the Agreement (including these Terms and Conditions) carefully and make sure you understand them. Should you not agree with their contents, please refrain from using the Service any further.
    3. In these Terms and Conditions, One Casino Limited is referred to as "One Casino", "we", "us" or "Our" and the Account Holder shall be alternatively referred to as "you", and "your", as and where appropriate.
  2. Definitions
    1. "Account" means the account held by the Player with us.
    2. "Agreement" means to the Terms and Conditions, the Game Rules, the Terms and Conditions of the General Bonus, as well as any rules or guidelines posted on or otherwise notified to the Player on the Website.
    3. "Game/s" means to the online games which are provided by One Casino via the website.
    4. "Group Companies" means, in relation to One Casino, any parent company and subsidiary of One Casino.
    5. "Website/s" means www.onecasino.com and downloadable software licensed to or owned by Us when accessed via any network or device.
    6. "Privacy Policy" means a document of the same name published on the Website and may be changed from time to time in the same manner.
    7. "Software" means software that is owned or authorised by or to Us.
    8. "Terms & Conditions" means the terms and conditions set out in this document as amended from time to time.
  3. General
    1. These Terms and Conditions apply equally irrespective of whether the Service is accessed via telephone, desktop browser, mobile browser, mobile, tablet device, or any other device.
    2. Unless otherwise expressly stated, these Terms and Conditions take precedence and prevail in the event of any inconsistencies between them and any other content or document referred to and/ or which forms part of the Agreement.

    4. One Casino Limited is licensed and regulated by:
      1. the Malta Gaming Authority (MGA) to offer type 1 gaming services under licence reference number MGA/B2C/327/2016

    6. This version of the Terms and Conditions is currently dated: July 31st, 2023. It is valid until a new version is in place on the Website and is accepted by the Account Holder in accordance with these Terms and Conditions.
    7. For the avoidance of doubt, the Agreement applies to the playing of Games via all platforms and devices that enable such access.
    8. One Casino reserves the right to modify the Terms and Conditions from time to time for a number of reasons, including to comply with applicable laws and regulations, as well as other regulatory requirements. Consequently, we may amend the Agreement at any time. Nevertheless, whenever a substantial amendment is made to the Terms and Conditions, we will notify you via a notice on the Website upon Account login and prior to the changes coming into effect. Upon being notified, you will then be required to re-confirm your acceptance of the contents therein. If you do not agree to the updated Terms and Conditions you will no longer be able to use the Service. The full Terms and Conditions are available on the front page of the Website at all times. It is always recommended that you check the Terms and Conditions prior to use of the Service to ensure that you agree with them. All versions are dated and time stamped.
    9. The amendments referred to in the preceding article will become effective immediately upon being posted on the Website. It is your sole responsibility to review the Terms and Conditions, including the specific Game Rules for each Game you choose to participate in to remain updated with all amendments each time you play. Moreover, it is always advisable to review these Terms and Conditions and the Game Rules of the Games you participate in, on a regular basis, so as to not forget their contents.
    10. You must read and understand the Terms and Conditions (and the Agreement as a whole) fully before registering an Account. Should you not agree with any part of the Agreement, you must not use or continue to use our Service.
    11. These Terms and Conditions become applicable when you register and confirm your registration details in the registration process on the Website. By registering an Account, you agree that you have read and understood these Terms and Conditions. By using our Service, you confirm that you have accepted and agreed to the contents contained herein.
    12. You further acknowledge that by registering and using our Service, you are also bound by the Game Rules, and it is deemed that you have read, understood and accepted all such Game Rules. You can find the rules concerning specific games in the ‘Game Rules’ page.
    13. These Terms and Conditions may be published in a number of languages and shall reflect the same principles. This is for information purposes and to help the Account Holder. It is however only the English version that is the legal basis of the relationship between you and One Casino. In case of any discrepancy between the English version and the non-English version of these Terms and Conditions, the English version shall always prevail.
  4. Your Obligations
    1. You may only open one Account at any time on the Website. One Casino retains the right to terminate any duplicate Account.
    2. If you open or attempt to open more than one Account, for whatever reason, One Casino may block or close any or all of your Accounts at its discretion. One Casino may also at its discretion void all the bets that have been placed or bonuses that have accrued in the duplicate Accounts. Should One Casino decide to leave one Account open, it will be the first Account that you opened with One Casino to which your remaining deposits, if any, will be transferred.
    3. If you notice that you have more than one registered Account you must notify us immediately. Failure to do so may lead to your Account being blocked and/ or closed. In the event that we consider that multiple Accounts have been opened in genuine error, One Casino may, at its sole discretion, agree to credit the first Account which you would have opened with us with any balance remaining in your additional Account(s).
    4. Persons below the age of 18 are not allowed to participate in the Games. You declare that you are over 18 years of age or comply with a higher minimum legal age as stipulated in the jurisdiction in which you are resident in and under the laws applicable to you. It is your sole responsibility to know whether online gambling is legal in your country of residence. It may be a criminal offence to gamble whilst being under age.
    5. You are solely responsible for your Account details and the use of your Account via such details. This includes but shall not be limited to the username and password and/or any other means to access your Account via the respective Website. Where you have a suspicion that such information may have been compromised, you must inform One Casino and take proper actions to prohibit or prevent any unauthorised access to any part of your Account or funds.
    6. You shall use our Service on your own behalf and not on behalf of any other person or entity. An Account may only be held by a natural person. For the avoidance of doubt, company accounts are not permitted. Moreover, you shall not allow any other natural person to access and/or use your Account or accept any prize or access and participate in any of the One Casino services. You understand that you shall be fully liable for any losses incurred by a third party on your Account and you shall immediately inform us should you suspect that a third party has obtained access to your Account, take proper actions to prohibit or prevent any unauthorised access to any part of your Account or funds, and assist us fully in our investigations into the matter.
    7. You may participate in the Games strictly in your personal non-professional capacity, for recreational and entertainment reasons only and in accordance with all laws, rules and regulations, if and where applicable.
    8. You are aware that the right to access and use our Service, may be considered illegal in certain countries or that access to our Service from certain countries may mandate limitations due to such a country’s status in any recognised index or ranking in the field of financial crime. You are responsible for determining whether your accessing and using our Service is compliant with the applicable laws in your country and you warrant to us that gambling is not illegal in the territory where you reside. One Casino also prohibits persons located in (including temporary visitors) or residents of certain jurisdictions. For the avoidance of doubt, access and registration from countries that do not feature on the dropdown options available at registration stage, is strictly prohibited. Your participation in the Games in a jurisdiction where such participation is prohibited by law or in a jurisdiction which, despite participation not being prohibited, may result in the imposition of limitations on your participation and/or access to the Games in any manner, shall not affect any stakes or payments made to and accrued for the benefit of One Casino.
    9. You are not allowed to transfer funds from your Account to other Account Holders or to receive funds from other Account Holders into your Account. Accounts are not transferable, and it is prohibited for Account Holders to sell, transfer or acquire Accounts from any other Account Holders.
    10. As an Account Holder, you are responsible for providing One Casino with correct personal details. To this effect you agree that all information that you give to us, such as but not limited to, an address and email address that is complete and true, and that you will immediately notify One Casino should there be changes to such information. You are hereby notified that we carry out verification procedures and, should One Casino become aware that you have failed to provide to us correct information, we retain the right to block the Account and refuse to process any refunds or winnings.
    11. You may participate in any Game only if you have enough funds in your Account for such participation.
    12. You may not use funds that are tainted or associated with any illegality and, in particular, funds that originate from any illegal activity or source. We moreover reserve the right to terminate an Account, ban an Account Holder and retain all funds where that Account Holder is reasonably suspected of engaging in or being directly linked to fraudulent activities which include, but are not limited to, the use of stolen or falsified credit cards or account numbers, chip dumping, software exploitation, forgery, collusion, and the submission of data or documents which are forged, stolen or otherwise misappropriated.
    13. You are solely responsible for abiding with any reporting processes related to the payment of taxes and/or other fees which might be charged on winnings that you receive from One Casino, if and where applicable.
    14. In relation to deposits and withdrawals of funds into and from your Account, you acknowledge that you shall only use such credit cards and other financial instruments that are valid and issued by lawful institutions and that legally belong to you. We retain the right to prohibit the use of company credit cards and company bank accounts.
    15. You understand and acknowledge that it is not permissible for you to play any Games offered by One Casino on credit.
    16. You understand and acknowledge that by playing the Games, you take the risk of losing money deposited into your Account. Should you not wish to accept this, kindly refrain from using our Service.
    17. You declare that you are not and shall not be involved in or directly linked to any fraudulent, collusive, fixing or other unlawful activity in relation to your or third parties’ participation in any of the Games and shall not use any software-assisted methods or techniques or hardware devices for your participation in any of the Games. We hereby reserve the right to invalidate any betting and deal as we see fit with any funds, should we suspect such behaviour. Moreover, any Account Holder who has reasonable grounds to suspect that another Account Holder is taking an unfair advantage through cheating or collusion is to report the suspicion to One Casino by sending an email to complaints@onecasino.com.
    18. As part of your use of the Service, we provide you with a live chat and telephone service, through which you can communicate with our Customer Support representatives. All conversations shall be recorded. Abusive or offensive language will not be tolerated. Use of the chat and telephone service should strictly relate to our services and any queries related thereto, to the extent that you interact with them in accordance with these Terms and Conditions, you shall be courteous to other Account Holders using the Website.
    19. You declare that you are not restricted by any form of legal incapacity.
    20. You will not disguise, or in any way interfere with the IP address and/or geolocation of your device used to access our services or otherwise take steps to prevent One Casino to correctly identify your actual IP address and/or geolocation of the device used to access the Services.
    21. Danish jurisdiction specific:
      1. Registration as a player with One Casino can only be done by a person who has a Danish CPR number.
      2. When logging in to the online game account on a computer, NEMID must be used.
      3. Upon registration, One Casino checks whether the player is registered in the Register of Voluntarily Excluded Players (ROFUS). If this is the case, the online gamming account and the customer relationship with One Casino will not be able to be set up.
  5. Your Account
    1. In order for you to be able to place bets and deposit money, you must first register personally with us and open an Account.
    2. As part of the registration process, you will have to choose your username and password for your login into the Website. It is your sole and exclusive responsibility to ensure that your login details are kept securely. You must not disclose your login details to anyone. We are not responsible for any abuse or misuse of your Account by third parties due to your disclosure, whether intentional or accidental, whether active or passive, of your login details to any third party.
    3. One Casino reserves the right to perform background checks on any Account Holder and request any relevant documentation, at all times and, for any reason, (including but not limited to) any investigation into the identity of the Account Holder, any credit checks performed on the Account Holder, or any necessary enquiries into the Account Holder’s personal history. The basis for such investigations will be dependent on the specific case, but could include (but is not limited to) verification of the Account Holder’s registration details, such as the name, address and age, occupation, verification of the Account Holder’s financial transactions, financial standing, source of wealth, source of funds and/or gaming activity. One Casino is under no obligation to advise the Account Holder of such an investigation taking place. Such activities may include the use of specific third-party companies, who perform the investigations as required. One Casino may decide at its sole discretion to terminate an Account, and withhold all funds in such Account, on the basis that such an investigation provides a negative (as determined at our reasonable discretion) conclusion.
    4. We allow more than one Account for each household, IP address and/or computer device. However, bonuses may only be granted to one such Account. If two or more Account Holders share the same household, IP address and computer device, One Casino must be informed by the respective Accounts holders. Should One Casino not be informed accordingly, One Casino shall have the right to close the relevant Account.
    5. One Casino reserves the right to suspend or terminate an Account at any time in cases where we have knowledge or reasonable suspicion that continuing its business relationship with you could negatively impact One Casino’s licensing and general regulatory obligations at our sole discretion and without any explanation whatsoever.
    6. One Casino reserves the right to refuse or close an Account at its sole discretion or if requested by any regulatory authority or payment service provider and without any explanation whatsoever, however, any contractual obligations already made by One Casino shall, without prejudice to any rights available at law to One Casino, be honoured accordingly.
    7. One Casino does not allow the use of robotic, automated, mechanical, electronic or other devices to make automated decisions in any Game, whether such use is attempted or affected by you or by any third parties. Should we have reasonable suspicion that any such device is being used on the Website, we reserve the right to void any bet that we suspect has been made using such a device and exclude the Account Holder from any promotion or competition in which we suspect that such a device has been used. You are also prohibited from utilising an external resource that is designed to provide an Account Holder with an unfair advantage over other Account Holders. Such prohibited external resources may include, but are not limited to, third-party software applications and databases as well as websites, web-based databases, subscription services and the assistance of any other person regardless of whether or not that person is also the holder of an Account. We may also suspend the Account in question pending investigation into the matter and terminate the Account at our sole discretion. One Casino considers the use of such devices to be tantamount to fraud and reserves its right not to refund any balance on the Account at the time of termination and to cancel any pending gameplay.
    8. In addition to the above, should we have reasonable grounds to believe that any fraud has been committed or attempted by you in relation to your (or another) Account, we reserve the right to cancel any related transaction, any bonus or any other promotion without prejudice to any other action or redress we might avail ourselves of. In these Terms and Conditions, a reference to ‘fraud’ shall be deemed to include ‘bonus abuse’. Bonus abuse includes, but is not limited to, opening more than one Account in order to claim an additional bonus or benefit.
    9. If you wish to close your Account, you may do so at any time, by contacting Customer Support by chat, ticket or phone on +356 27782188 subject to proper Account verification and other verification processes. Any funds in the Account will be remitted to you. The effective closure of the Account will correspond to the termination of the Terms and Conditions, however any obligations already entered into shall be honoured.
    10. Where the requested Account closure is related to concerns about possible gambling addiction, the Account Holder shall indicate as such to One Casino. An Account Holder who closes an Account for gambling addiction reasons shall not open or try to open a new Account. One Casino shall not be liable for any direct or indirect consequential damages, should an individual succeed in opening a new Account. We reserve the right to close an Account opened in breach of this rule at any point in time. The full provisions of these Terms and Conditions relating to Responsible Gambling (including temporary or indefinite suspension of your Account) are contained in Section 10.
    11. All communication between the Account Holder and One Casino is kept on record for compliance, as well as accounting and financial regulations’ purposes. Where an Account is closed, related information about the Account is saved for up to five (5) years from the time the Account is closed. Related information includes (but is not limited to) Account Holder name, address, phone, email and Account transactional details. After this time period all the information will be securely archived.
    12. You may not apply for an Account or use any of the Service if you or a member of your household are or have in the last five (5) years been employed with One Casino. For the purposes of this Section 5, "employee" includes third party contractors such as licensors, software suppliers, developers or partners and all those persons in any way affiliated with us.
    13. One Casino does not offer our services to Account Holders who are identified as Politically Exposed Persons (PEP). Should you be identified a PEP at any stage, your Account will be closed and any remaining real money balance will be returned (subject to general regulatory obligations). If you disagree with our determination of your PEP status, please contact us.
    14. You may wish to take a break from playing on One Casino for reasons, which are not specifically related to managing the extent of your gameplay and spending. In such cases you may opt to set a "Timeout" or "Self-Exclusion" period on your Account. Your Time-Out periods may be set for 1 day, 7 days or 30 days. Should you wish to set a Timeout on your Account, you may either set the Timeout yourself by going to the settings of your Account or by contacting Customer Support on 356 27782188 or info@onecasino.com. Please be aware that if you close your Account for a Timeout, we may allow you to reopen your Account prior to the lapse of the Timeout term. Should you wish to take a break from gambling in general, please refer to section 8 of these Terms and Conditions.
    15. One Casino has the right to appoint payment solution providers to act, receive and/or pay funds on its behalf in relation to your Account.
    16. You shall not treat One Casino as a financial institution nor expect any interest on funds held in your Account.
    17. For marketing purposes, usernames may be published by US on our website.
    18. Danish jurisdiction specific:
      1. User accounts from Denmark who did not complete their customer identification process, will be marked as “Temporary gambling account”. Temporary gambling accounts will not be able to deposit over 10.000 kr. (cumulatively) and will be closed after one month.
      2. The player can finally register in the Danish Authority's Register of Voluntarily Excluded Players (ROFUS) by contacting the Danish Gaming Authority or via https://rofusweb.spillemyndigheden.dk. By giving consent to registration herein, the player may be temporarily or permanently excluded from playing online games in Denmark.
  6. Deposits into Your Account
    1. When you open an Account, we do not require you to make a minimum deposit before you can bet or play. However, a minimum deposit is required for withdrawals. We will otherwise specify minimum deposit levels and maximum deposit levels from time to time. You acknowledge that you may only wager and play with the amount of cleared funds held in your Account. Consequently, if you would like to participate in gaming, you must deposit money into your Account. You can make a deposit at any time online by using our accepted payment methods for your Account. Cash or cheques are not an accepted method of deposit. Certain payment methods may not be available to you depending on certain factors such as jurisdiction and currency.
    2. By depositing funds into your Account (and without prejudice to your right to withdraw them in accordance with these Terms and Conditions), you direct us and we agree to hold them, along with any winnings, for the sole and specific purpose of using them (i) to place any gaming stakes and (ii) to settle any fees or charges that you might incur in connection with the use of the Service.
    3. Depositing funds into your Account shall at all times be made through the methods specified on the Website, as may be amended from time to time. Procedures, terms, availability and duration for transactions may vary depending on the time, the country and the Financial Institution used. Details about the timings for withdrawals in respect to the payment method utilized are available on the relevant pages of the Website, and these may be amended from time to time.
    4. Deposited funds are available in the Account within a reasonable amount of time following the confirmation of the deposit made, unless extra verification procedures as stated under Section 4.7 are required.
    5. One Casino reserves the right to use additional procedures and means to verify your identity, both before and after effecting deposits into your Account.
    6. If One Casino mistakenly credits your Account with winnings that do not belong to you, whether this is due to a technical or human error or otherwise, the amount will remain property of One Casino and will be transferred back to us from your Account. We reserve the right to void any transactions placed using such funds, including related winnings. To satisfy any such liability, we further reserve the right to freeze and withhold these funds and set-off any subsequent winnings owed to you. If prior to One Casino becoming aware of the error, you have withdrawn funds that do not belong to you, without prejudice to other remedies and actions that may be available to us at law, the mistakenly paid amount will constitute a debt owed by you to One Casino. In the event of an incorrect crediting, you are obliged to notify our Customer Support services immediately by email.
    7. You shall only use debit or credit cards and other financial instruments that are valid and lawfully belong to you.
    8. Being a Cardholder, you are obliged to know the laws and regulations concerning online gambling in the Cardholder’s country.
    9. To ensure full traceability of your purchases/deposits, it is advised to keep a record of your transactions. Please read carefully your Merchant's T&C's
    10. The minimum deposit in order to affect your first withdrawal amount is ten (10) EUR (and any other currency equivalent) with the exception of Canada and Denmark. In the case of Denmark, the minimum deposit in order to effect your first withdrawal is of 100DKK and for Canada, the minimum deposit in order to effect your first withdrawal is ten (10) Canadian dollars CAD. One Casino retains the right to change this minimum amount at any time should we deem so appropriate.
    11. In accordance with our anti-fraud policies, we reserve the right to pay any requested withdrawal partly or in total via the same method of payment through which one or more deposits were made. We further reserve the right to pay any requested withdrawal directly to your bank account.
    12. One Casino accepts payments made in Euro (EUR), Canadian Dollars (CAD) and Danish Krone (DKK). In case your payment account (i.e. your bank account or your eWallet-account) is in a different currency, One Casino, or your bank/eWallet, as the case may be, will accordingly convert the funds to EUR before depositing it to your Account. Likewise, the funds you withdraw will be sent to you in EUR and One Casino or your bank/eWallet, as the case may be, will convert the funds to your payment account currency. Please note that any exchange premiums are payable by the Account Holder.
    13. Deposits made to your Account should be commensurate with game play. If in One Casino’s discretion, there is suspicion of abuse (for instance, where a deposited amount has not been wagered or used for an appropriate level of game play and the Account Holder then makes a withdrawal request in relation to that deposited amount or where One Casino suspects that you are abusing exchange rate fluctuations or made a financial gain through arbitrage), we reserve the right, in our absolute discretion, to cancel other deposit(s), and/or any withdrawals there related, in part or in full, to deduct and/or to retract any balance or costs that may have resulted in conjunction therewith from any funds held in the Account, confiscate funds including winnings and to close the Account indefinitely, without any warning and notification. We further reserve the right to request and obtain satisfactory proof of deposit and additional copies of personal identification and other documents as may be required at any stage during the Account’s lifetime and in such instances prior to processing any withdrawal request, the processing of such request to be entirely at One Casino’s discretion. In cases where we are not satisfied by the submitted documentation, One Casino may cancel the withdrawal and return the funds to the Account or confiscate the funds and block the Account indefinitely.
    14. You agree that the funds deposited in your Account must only be used for playing the Games. We shall be entitled to suspend or close your Account if we reasonably believe that you are depositing funds without any intention to place gaming stakes. In such circumstances we may also report this to relevant authorities.
    15. One Casino does not grant any credit for use of the Service.
    16. You acknowledge that we shall have the right to block an Account should we receive a chargeback or reversal request in relation to that Account. When a chargeback/reversal request has been received, we will reserve the right to immediately confiscate any available funds in your account to offset the amount and the corresponding cost of the chargeback/reversal. Furthermore, we will contact you as the registered Account Holder, so as to seek confirmation of your identity and if necessary, we shall also ask you to confirm your preferred method of payment. Reminders may be sent should the requested confirmation not be received. Administrative fees may apply in such cases and the balance of your Account may decrease in the case of unduly incurred chargebacks, reversals or other charges we may sustain in relation to your Account. You are to note that any remaining funds held in an Account which has been blocked due to a chargeback request, shall be treated as though they were funds on an inactive Account and the procedure laid down under section 9 of these Terms and Conditions shall apply.
  7. Withdrawals
    1. Available withdrawal options are clearly stated on the Website and may differ depending on the jurisdiction in which the Account Holder resides.
    2. Withdrawals will be made to the withdrawal method available to you, as selected via the "Withdrawal" pages and/or as chosen by One Casino. Whenever possible, One Casino shall pay your withdrawals by using the same method as the deposits. Withdrawal payments may only be made in the name of and to the registered Account holder. One Casino reserves the right to require the Account Holder to withdraw to a particular withdrawal method. It is your responsibility to ensure that deposits are made from an account in your own name. Where One Casino becomes aware that deposits were made from an account of a third party, One Casino reserves the right to refuse the processing of your withdrawal and block your Account. However, One Casino retains the discretion, following appropriate verification of the third party, to process the withdrawal by transferring the funds to the source where the original deposit was made from.

  9. Inactive Accounts
    1. An "Inactive Account" is an Account that has not been accessed for six (6) consecutive months, that has a real money balance.
    2. Upon an Account being deemed an "Inactive Account" or "Closed Account", One Casino reserves the right to communicate with the Account Holder to determine the procedure as to whether to revive the Account or otherwise.       An Inactive Account remain opens and the balance is never removed unless the Player requests to close the Account.

      Suspended Gambling Accounts

We may remove any Game from the Website at any time we see fit and reserve the right to make changes or amendments, to alter, suspend or discontinue any element of the Service (including the Website content and your access to the Service).

You agree fully to indemnify, defend and hold us, and our officers, directors, employees, agents, contractors and suppliers, harmless immediately on demand, from and against all claims, liabilities, damages, losses, costs and expenses including legal fees, arising out of any breach of these Terms and Conditions (including but not limited to Section 15) by you or any other liabilities arising out of your access and use of the Service (or by anyone else using your Account).
    8. To the extent permitted by law, One Casino shall not be liable for any loss, costs, expenses or damages, whether direct, indirect, special, consequential, incidental or otherwise, arising in relation to your use of the Service (including but not limited to use of the Website or your participation in the Games), including (without limitation) loss or corruption of data, loss of profit, loss of savings, reduced goodwill, loss due to business interruption, loss in connection with the use of items, materials or software or omissions in content, the scrambling, destruction or loss of data or documents.
    9. Where the liability contemplated by Section 14.8 cannot be excluded in full, and to the extent permitted by law, the liability of One Casino for damage or loss (whether direct, indirect, special, consequential, incidental or otherwise) for use of the Service, regardless of the cause of action (whether in contract, tort or otherwise), will not exceed €100.

Neither One Casino nor any of its independent providers is liable for any information errors, incompleteness, inaccuracy or delays, or for any actions taken in reliance of information contained on the Website.
  15. Intellectual Property
    1. One Casino, its Group companies and its licensors are the sole holders of all rights in the software forming part of the Service (including that contained on the Website and in the Games) (the "Software") and the Software’s code (including the underlying source code and software), structure and organisation, including copyright, trade secrets, intellectual property and other rights.
    2. The name "One Casino" and any other trademarks, service marks, signs, trade names and/or domain names used by One Casino on the Websites and/or its applications from time to time (the "Trademarks"), are the trademarks, service marks, signs, trade names and/or domain names of One Casino and/or its Group companies and/or licensors, and these entities reserve all rights to such Trademarks.
    3. All content on the Website, including, but not limited to, the Software, images, pictures, graphics, photographs, animations, videos, music, audio and text (the "Site Content") belongs to One Casino and/or its Group companies and/or its licensors and is protected by copyright and/or other intellectual property or other rights. You hereby acknowledge that by using the Service you obtain no rights in the Site Content and/or the Trademarks, or any part thereof. Under no circumstances may you use the Site Content and/or the Trademarks without One Casino’s prior written consent.
    4. The rights referred to in Sections 15.1, 15.2 and 15.3 are collectively referred to as the "Intellectual Property".
    5. You agree not to do anything that will harm or potentially harm the Intellectual Property held by One Casino, its Group companies and/or its licensors (including any Third Party Providers) nor will you do anything that damages the image or reputation of One Casino, its Group companies, employees, directors, officers and consultants.
    6. The Agreement grants you a non-exclusive, non-transferable, revocable, personal licence to the Intellectual Property for the sole purpose of displaying the Website (including the Games) on your personal computer (or other device) and for transacting with it in accordance with these Terms and Conditions.
    7. Any use of the Intellectual Property beyond that contemplated by Section 13.6 is strictly prohibited. Accordingly, and without limitation, you may not, within the limits prescribed by applicable laws:
      1. copy, distribute, publish, reverse engineer, decompile, disassemble, modify, or translate the Software or make any attempt to access the source code to create derivative works of the source code of the Software, or otherwise;
      2. sell, assign, sublicense, transfer, distribute or lease the Software;
      3. make the Software available to any third party through a computer network or otherwise;
      4. export the Software to any country (whether by physical or electronic means); or
      5. use the Software in a manner prohibited by applicable laws or regulations.

    8. The licence granted to you in Section 15.6 shall automatically terminate if you breach Section

  16. Breach, Damages and Termination
    1. If you breach any provision of these Terms and Conditions or should we have reasonable grounds to suspect that you have breached them, we reserve the right to not open, to suspend, or to close your Account, or withhold the payment of your winnings and apply such funds on Account for any damages due by you.
    2. If One Casino suspects that you are engaged in illegal and/or fraudulent activities when using the Service or that you are in breach of the Terms and Conditions or that you are having problems with creditors or that you are otherwise engaged in actions which may be detrimental to our business, we retain the right to freeze or terminate your Account or cancel any stakes at our absolute discretion.
    3. You acknowledge that One Casino shall be the final decision-maker on whether you have breached any of One Casino’s rules, policies and/or Terms and Conditions, in a manner that results in the suspension or permanent barring from participation in our site(s).
    4. Should we delay or fail to enforce our rights under these Terms and Conditions, this does not mean that we are losing or waiving the rights afforded by them where set timelines have not been set out. The same shall also apply to you.
    5. We will not be liable to you for any breach of these Terms and Conditions which arises because of any circumstances that we cannot be reasonably expected to control.
  17. Severability

    If any provision of these Terms and Conditions is held to be illegal or unenforceable, such provision shall be severed from these Terms and Conditions and all other provisions shall remain in force and unaffected by any such severance.
  18. Assignment

    We reserve the right to assign or otherwise lawfully transfer the Agreement. You however, shall not assign or otherwise transfer this Agreement.
  19. Entire Agreement

    The Agreement constitutes the entire understanding between you and us with respect to the use of our Service and, save in the case of fraud, they shall supersede all prior or contemporaneous communications, proposals and agreements, whether electronic, oral or written, between you and us with respect to the Service.
  20. Applicable Law and Jurisdiction
    1. Any legal claim or dispute arising under or in connection with the Agreement shall be settled in accordance with the governing law of the place of the contract. The place of contract of this Agreement is Malta and it is governed by the Laws of Malta.
    2. Save where otherwise expressly specified in accordance with Section 13, any dispute, controversy or claim arising out of or in connection with the Agreement, or the breach, termination or invalidity thereof, shall be submitted to the exclusive jurisdiction of the Maltese courts (or applicable Maltese regulatory body). We cannot accept responsibility under the laws of any other jurisdiction.
